Declaratory Judgment

Judicial Orders, Injunctions & Precedents

Definition

A formal judicial determination that conclusively defines the legal status, rights, or obligations of the parties without ordering any specific executory action or awarding coercive damages (codified under Section 34 of the Specific Relief Act, 1963).

Example

In a title suit before the City Civil Court at Hyderabad, the judge passes a declaratory judgment declaring that the plaintiff is the absolute owner of the commercial property, leaving the recovery of actual physical possession to a separate execution prayer.
