Ex-Parte Injunction vs. Injunction After Notice

Judicial Orders, Injunctions & Precedents

Definition

Ex-Parte Injunction: Granted without serving prior notice or hearing the defendant, based on grave, imminent emergency under Order XXXIX Rule 3 CPC.

Injunction After Notice: Granted only after formal summons and notice are served on the defendant, allowing them to file a written reply and present oral arguments.

Example

An ex-parte injunction is granted on Friday night to stop tree cutting; following appearance and detailed replies from the forest department on Monday, the court hears both sides and decides whether to grant an injunction after notice.
