Judicial Orders, Injunctions & Precedents

Definition

An extraordinary equitable order issued by a domestic court restraining a party from instituting or prosecuting legal proceedings in a foreign court, granted sparingly when the foreign proceedings are vexatious, oppressive, or in breach of an exclusive jurisdiction clause.

Example

In Modi Entertainment Network v. W.S.G. Cricket Pte. Ltd., the Supreme Court laid down the definitive principles governing the grant of an anti-suit injunction, holding that Indian courts can restrain a party from proceeding in an oppressive foreign forum.
