Non-Speaking Order

Judicial Orders, Injunctions & Precedents

Definition

An order that pronounces a conclusion, dismissal, or penalty without disclosing any underlying factual analysis, evidence evaluation, or legal reasoning, rendering it vulnerable to being quashed in judicial review.

Example

An administrative officer rejects an environmental clearance application with the single phrase "Clearance rejected as unsatisfactory"; the High Court quashes the non-speaking order and remands the matter for a reasoned decision.
