Speaking Order

Judicial Orders, Injunctions & Precedents

Definition

An order or judgment that contains clear, logical, and intelligible reasons for the conclusion reached, enabling the litigants and appellate courts to understand the factual and legal basis of the decision.

Example

In Siemens Engineering & Manufacturing Co. v. Union of India, the Supreme Court held that every quasi-judicial authority must pass a reasoned, speaking order, as recording reasons is the fundamental guarantor against arbitrariness.
