Legal Duty and Rights (Actus Curiae Neminem Gravabit)
Canons of Statutory Interpretation
Definition
"An act of the court shall prejudice no man." A canon establishing that delays, administrative filing errors, or systemic mistakes committed by the court or its registry cannot be used to deprive a litigant of their statutory rights.
Example
In A.R. Antulay v. R.S. Nayak, the Supreme Court held that an earlier administrative direction of the court that bypassed a statutory trial forum was an error of the court, invoking actus curiae neminem gravabit to rectify the mistake.
