Effect of Repeal (Section 6 General Clauses Act, 1897)

Canons of Statutory Interpretation

Definition

The statutory rule that unless a different intention appears, the repeal of an enactment does not revive anything not in force, affect past operations, affect rights, privileges, or obligations acquired, or affect investigations and legal proceedings regarding incurred liabilities.

Example

In M/s S.L. Srinivasa Jute Twine Mills v. Union of India, the Supreme Court held that liabilities incurred and accrued rights under an Act prior to its repeal remain enforceable under Section 6 of the General Clauses Act.
