Mandatory vs. Directory Provisions

Canons of Statutory Interpretation

Definition

A mandatory provision must be obeyed strictly, and failure to comply renders the proceeding or act null and void; a directory provision requires substantial compliance, and non-compliance does not automatically invalidate the act.

Example

In Sharif-ud-Din v. Abdul Gani Lone, the Supreme Court held that statutory provisions requiring attestation of election petition copies are mandatory, and non-compliance leads to automatic rejection of the petition.
