Explanation to a Section

Canons of Statutory Interpretation

Definition

An explanatory clause added to a section to clarify, remove doubts, or expand the meaning of a particular word or phrase used in the main enacting provision, without creating a new independent right or liability.

Example

In Bengal Immunity Co. v. State of Bihar, the Supreme Court interpreted the Explanation to Article 286(1)(a), establishing that an explanation must be read to explain what is ambiguous in the main section, not to introduce a foreign exception.
