Subject To Clause

Canons of Statutory Interpretation

Definition

A statutory phrase indicating that the operation, power, or right conferred by that particular section is subordinate, conditional upon, and yielding to the provisions of another specified section or statute.

Example

In South India Corporation (P) Ltd. v. Secretary, Board of Revenue, the Supreme Court held that the phrase "subject to" used in Article 372 clearly indicates the subordinate status of the provision relative to other constitutional clauses.
