Procedural Amendments are Retrospective

Canons of Statutory Interpretation

Definition

The statutory rule that enactments or amendments dealing purely with procedure, remedies, modes of trial, or limitation periods apply retrospectively to all pending actions from the date they come into force, unless the Act states otherwise.

Example

In Sudhir G. Angur v. M. Sanjeev, the Supreme Court affirmed that all procedural laws are retrospective in character unless the amending statute explicitly provides that pending actions shall continue under the repealed procedure.
