Purposive Approach to Beneficial / Remedial Legislation

Canons of Statutory Interpretation

Definition

The interpretative principle that welfare, remedial, or beneficial legislation (such as labor codes, consumer protection, and maternity benefits) must receive a broad, liberal construction that advances the social purpose rather than a narrow technical interpretation.

Example

In B. Shah v. Presiding Officer, Labour Court, Coimbatore, the Supreme Court interpreted the Maternity Benefit Act, 1961, holding that "wages" payable for maternity benefit must include Sundays and rest days to fulfill the beneficial legislative object.
