In Absentia Hearing (Violation of Natural Justice)

Principles of Natural Justice & Equity

Definition

Conducting an adverse disciplinary inquiry, trial, or quasi-judicial proceeding in the absence of the affected party without establishing that they were duly served with notice or intentionally evaded appearance.

Example

A state university cancels a student’s doctoral degree following an internal inquiry where the student was never issued an inquiry notice; the High Court quashes the cancellation order for violating natural justice.
