Ex Turpi Causa Non Oritur Actio

Principles of Natural Justice & Equity

Definition

"No action arises from a dishonorable or illegal cause." A foundational rule of law and equity stating that a plaintiff cannot pursue a legal or equitable remedy if the claim is founded upon an immoral or illegal contract.

Example

A smuggler sues a transport carrier for damages because a hidden consignment of banned contraband was damaged in transit; the civil court dismisses the suit at the threshold under ex turpi causa.
