Volenti Non Fit Injuria

Principles of Natural Justice & Equity

Definition

"To a willing person, injury is not done." A defense in the law of torts establishing that an individual who knowingly, willingly, and voluntarily agrees to run the risk of harm cannot maintain an action for damages if that harm occurs.

Example

In Hall v. Brooklands Auto Racing Club (applied across Indian tort trials), a spectator struck by racing car debris cannot sue the stadium for damages because attending the race implied voluntary assumption of that known risk.
