Resulting Trust
Principles of Natural Justice & Equity
Definition
An equitable implication that arises when property is transferred to someone, but the beneficial interest returns (results) to the transferor because the transfer failed, was gratuitous, or did not exhaust the entire equitable estate.
Example
A settlor transfers ₹50 lakh to trustees to fund a school for fifteen years; upon the expiration of the fifteen-year trust period without further instructions, the surplus funds revert to the settlor under a resulting trust.
