Approbate and Reprobate

Principles of Natural Justice & Equity

Definition

An equitable doctrine holding that a person cannot "blow hot and cold" at the same time—meaning they cannot accept the benefits of a transaction, deed, or judgment and simultaneously challenge its validity or repudiate its burdens.

Example

In R.N. Gosain v. Yashpal Dhir, the Supreme Court held that a tenant who sought and secured an extension of time from the court to vacate premises by giving an undertaking could not subsequently challenge the eviction order in appeal, as they could not approbate and reprobate.
