Rescission of Contracts (Section 27 Specific Relief Act)

Principles of Natural Justice & Equity

Definition

An equitable remedy that annuls and unwinds a contract from its inception, restoring the parties to their pre-contractual positions, available where the contract is voidable by the plaintiff or terminated due to fault.

Example

A purchaser discovers that the seller fraudulently concealed a permanent municipal acquisition notice affecting 80% of a commercial plot; the purchaser secures a decree for the rescission of the contract and recovery of the earnest money.
