He Who Seeks Equity Must Do Equity

Principles of Natural Justice & Equity

Definition

An equitable principle dictating that a litigant asking the court to grant an equitable remedy must be prepared to act fairly and honor their own corresponding moral and legal obligations toward the opposing party.

Example

A borrower seeking a civil injunction to restrain a bank from auctioning mortgaged property must first demonstrate good faith by depositing a reasonable portion of the admitted, uncontested loan default into court.
