Ubi Jus Ibi Remedium

Principles of Natural Justice & Equity

Definition

"Where there is a right, there is a remedy." A foundational maxim of equity establishing that if a person possesses a recognized legal or civil right, the legal system must provide a court and an efficacious mechanism to enforce that right.

Example

In Sardar Amarjit Singh Kalra v. Pramod Gupta, the Supreme Court affirmed that procedural laws are designed to facilitate justice under the maxim ubi jus ibi remedium, and no substantive right should be defeated by mere procedural technicalities.
