Reasoned Decision / Speaking Order

Principles of Natural Justice & Equity

Definition

The requirement that an administrative body, tribunal, or court must record and communicate clear, logical reasons for its decision, functioning as a third pillar of natural justice to prevent arbitrariness and facilitate judicial review.

Example

In S.N. Mukherjee v. Union of India, the Supreme Court held that recording reasons is an essential element of natural justice, and an administrative authority exercising quasi-judicial functions must pass a speaking order.
