Post-Decisional Hearing

Principles of Natural Justice & Equity

Definition

An equitable compromise where an urgent administrative action is taken without prior notice due to an emergency, but is immediately followed by a comprehensive hearing to review, modify, or revoke the decision.

Example

In Swadeshi Cotton Mills v. Union of India, the Central Government took over the management of an industrial undertaking without prior notice; the Supreme Court held that while prior notice was bypassed due to emergency, a post-decisional hearing had to be granted immediately to satisfy natural justice.
