Improper Admission and Rejection of Evidence (Section 167 IEA / Section 155 BSA)

Evidentiary Rules & Proof Standards

Definition

A statutory rule establishing that the improper admission or rejection of evidence shall not be a ground of itself for a new trial or reversal of any decision, if the appellate court finds there was sufficient independent evidence to justify the decision.

Example

A trial judge mistakenly admits an uncertified photocopy of an invoice; on appeal, the High Court upholds the decree under Section 167 IEA because three independent witnesses and bank account transfers proved the transaction independently.
