Re-Examination (Section 137 & 138 IEA / Section 135 & 136 BSA)

Evidentiary Rules & Proof Standards

Definition

The subsequent examination of a witness by the party who called them, conducted after the cross-examination, strictly directed to explaining matters referred to in cross-examination (no new matters allowed without court leave).

Example

During cross-examination, defense counsel elicits that the witness gave two different dates for a meeting; in re-examination, the prosecutor asks the witness to clarify that the first date referred to a telephonic chat and the second to a physical meeting.
