Leading Questions (Section 141–143 IEA / Section 139–141 BSA)

Evidentiary Rules & Proof Standards

Definition

Any question that suggests the specific answer which the person putting it wishes or expects to receive; barred in examination-in-chief and re-examination (except with permission), but freely permitted in cross-examination.

Example

The public prosecutor asks their own witness: "Did you see the accused wearing a red jacket and holding a sword at 9 PM?" The defense objects to this leading question under Section 142 IEA, forcing the prosecutor to rephrase: "What was the accused wearing?"
