Estoppel (Section 115 IEA / Section 121 BSA)

Evidentiary Rules & Proof Standards

Definition

A rule of evidence preventing a party who has, by declaration, act, or omission, intentionally caused another to believe a thing to be true and to act upon that belief, from denying the truth of that thing in subsequent litigation.

Example

In B.L. Sreedhar v. K.M. Munireddy, the Supreme Court reaffirmed that estoppel prevents an owner who formally witnessed and attested a deed representing that their agent had authority to sell from later challenging the sale against the purchaser.
