Accomplice Evidence (Section 133 IEA / Section 138 BSA)

Evidentiary Rules & Proof Standards

Definition

A statutory rule establishing that an accomplice is a competent witness against an accused, and a conviction is not illegal merely because it proceeds upon the uncorroborated testimony of an accomplice (read with Section 114 Illustration (b), which cautions that an accomplice is unworthy of credit unless corroborated in material particulars).

Example

In Bhuboni Sahu v. The King, the Privy Council held that the court must seek independent material corroboration linking the accused to the crime before relying safely upon the deposition of an accomplice.
