Presumption of Abetment of Suicide by Married Woman (Section 113A IEA / Section 117 BSA)

Evidentiary Rules & Proof Standards

Definition

A discretionary statutory presumption allowing the court to presume that a husband or his relatives abetted the suicide of a married woman if the suicide occurred within seven years of marriage and she was subjected to cruelty under Section 498A IPC.

Example

A woman commits suicide four years after marriage following verified complaints of domestic assault recorded with the women's grievance cell; the court invokes Section 113A IEA to presume abetment by the spouse.
