Presumption as to Dowry Death (Section 113B IEA / Section 118 BSA)

Evidentiary Rules & Proof Standards

Definition

A mandatory statutory presumption requiring the court to presume that a person caused a dowry death if it is shown that soon before her unnatural death, the woman was subjected by the accused to cruelty or harassment in connection with any demand for dowry.

Example

In Satman Singh v. State of Punjab, the Supreme Court held that once the prosecution proves cruelty linked to dowry demands occurring "soon before" the unnatural burn death, the presumption under Section 113B operates mandatorily against the husband.
