Burden of Proving Specific Fact (Section 103 IEA / Section 106 BSA)

Evidentiary Rules & Proof Standards

The burden of proving any particular fact lies on that person who wishes the court to believe in its existence, unless the law provides otherwise.

Example

An accused charged with theft claims they purchased the stolen gold chain from a registered jeweler in Delhi; the burden of proving that specific purchase lies entirely upon the accused.
