Judicial Notice (Section 56 & 57 IEA / Section 51 & 52 BSA)

Evidentiary Rules & Proof Standards

Definition

The formal recognition and acceptance by a court of certain universally known or statutorily recorded facts (public statutes, boundaries, hostilities, national flag) without requiring the parties to introduce evidence to prove them.

Example

A trial judge takes judicial notice of the fact that a nationwide lockdown was declared by the Central Government on March 24, 2020, dispensing with the need for the defendant to call a government witness to prove why their transport operations stopped.
