Res Gestae (Section 6 IEA / Section 4 BSA)

Evidentiary Rules & Proof Standards

Definition

Statements, exclamations, or acts that occur so contemporaneously with the main event that they form part of the same transaction, making them admissible as a recognized exception to the hearsay rule.

Example

In Gentela Vijayavardhan Rao v. State of A.P., the Supreme Court held that for an utterance to be admissible as res gestae, it must be spontaneous and contemporaneous with the event, without interval allowing for fabrication or reflection.
