Evidentiary Rules & Proof Standards

Definition

A fact that is not directly in issue, but is so connected with a fact in issue according to the rules of relevancy laid down in the statute (such as cause, effect, motive, or preparation) that it renders the fact in issue probable or improbable.

Example

In a poisoning trial, the fact that the accused purchased potassium cyanide under a false name from a chemical supplier three days prior to the victim's death is a relevant fact showing preparation under Section 8 IEA.
