Alibi (Section 11 IEA / Section 9 BSA)

Criminal Procedure & Jurisprudence Terms

Definition

An affirmative defense raised by an accused asserting that they were at a different, physically distant location at the exact time the crime was committed, making their presence at the crime scene impossible.

Example

In Dudh Nath Pandey v. State of U.P., the Supreme Court laid down that the plea of alibi can succeed only if the accused produces strict, watertight proof establishing complete physical impossibility of being present at the scene of occurrence.
