Non-Bailable Warrant (NBW)

Criminal Procedure & Jurisprudence Terms

Definition

A written judicial warrant issued by a criminal court directing law enforcement officers to arrest an accused who has repeatedly failed to appear in response to summonses and bailable warrants.

Example

In Inder Mohan Goswami v. State of Uttaranchal, the Supreme Court held that courts should not issue an NBW in the first instance, but must reserve it for cases where the accused is intentionally evading the court.
