Section 27 Recovery (Indian Evidence Act / Section 23 BSA)

Criminal Procedure & Jurisprudence Terms

Definition

The statutory exception to the ban on police confessions, making admissible that part of an accused's custodial statement which leads directly to the discovery of a distinct physical fact or object (weapon, stolen jewelry, corpse).

Example

In Pulukuri Kottaya v. King-Emperor, the Privy Council established the parameters of Section 27 recovery; the statement "I have hidden the dagger in the dry well behind the temple" is admissible insofar as it leads police to recover that specific dagger.
