Section 151 CPC (Inherent Powers of Civil Court)

Civil Procedure & Litigation Mechanics

Definition

The statutory saving clause confirming that nothing in the CPC limits or affects the inherent power of the civil court to make such orders as may be necessary for the ends of justice or to prevent the abuse of the process of the court.

Example

In Manohar Lal Chopra v. Rai Bahadur Rao Raja Seth Hiralal, the Supreme Court held that civil courts have inherent powers under Section 151 CPC to grant an injunction restraining a party from proceeding with a parallel suit in another court in the interests of justice, even if the specific provisions of Order XXXIX do not apply.
