Interpleader Suit (Section 88 & Order XXXV CPC)

Civil Procedure & Litigation Mechanics

Definition

A suit instituted by a person who claims no interest in a disputed property or debt (other than charges or costs) against two or more rival claimants who assert competing rights to that property, seeking a judicial decree as to whom the property should be handed over.

Example

A warehouse company in Kolkata holds 500 bales of raw jute. Two separate business factions present conflicting consignment notes claiming ownership. The warehouse owner files an interpleader suit placing the jute under court control and praying for discharge after recovering storage costs.
