Three Pillars of Injunction (Dalpat Kumar Test)

Civil Procedure & Litigation Mechanics

Definition

The tri-partite test established in Dalpat Kumar v. Prahlad Singh that a plaintiff must establish to secure an injunction: (1) a prima facie case, (2) balance of convenience in their favor, and (3) irreparable injury that cannot be compensated in money.

Example

A merchant in Mumbai seeks to stop an unlawful bank guarantee encashment; the court rejects the injunction because the financial loss can be recovered via a money decree, failing the test of irreparable injury.
