Order VII Rule 11 (Rejection of Plaint)

Civil Procedure & Litigation Mechanics

Definition

A statutory provision empowering the court to summarily dismiss a plaint at the threshold without entering into trial if it does not disclose a cause of action, is undervalued, insufficiently stamped, or is barred on its face by any statutory law.

Example

In Dahiben v. Arvindbhai Kalyanji Bhanusali, the Supreme Court upheld the rejection of a plaint under Order VII Rule 11(d) CPC because the suit seeking cancellation of a sale deed was filed five years after registration, making it barred on the face of the plaint by the 3-year limitation rule.
