Tender Jurisdiction Writs

Prerogative Writs & Extraordinary Remedies

Definition

The narrow scope of judicial review under Article 226 over the award of government infrastructure contracts, restricted to assessing whether the tender decision-making process was arbitrary, discriminatory, or tainted by bias.

Example

In Tata Cellular v. Union of India, the Supreme Court laid down that courts in writ jurisdiction do not act as an appellate authority over tender evaluations, but solely examine the procedural fairness of the award.
