Blacklisting Writs

Prerogative Writs & Extraordinary Remedies

Definition

An Article 226 writ petition challenging an executive order that bans or debars a private vendor or contractor from participating in future public procurement tenders on the ground of arbitrariness or failure to issue a prior show-cause notice.

Example

In Eurasian Equipment & Chemicals Ltd. v. State of West Bengal, the Supreme Court held that the State cannot blacklist a government contractor without giving them an opportunity to be heard, as it impairs their civil and business rights.
