Certiorari

Prerogative Writs & Extraordinary Remedies

Definition

"To be certified." A supervisory writ issued by a constitutional court to quash, invalidate, and set aside an order already passed by an inferior court, tribunal, or quasi-judicial authority that acted without jurisdiction, in excess of statutory powers, or in gross violation of natural justice.

Example

In Syed Yakoob v. K.S. Radhakrishnan, the Supreme Court laid down that Certiorari lies to correct a jurisdictional error or an error of law apparent on the face of the record committed by a State Transport Appellate Tribunal.
