General Power to Amend Pleadings (Order VI Rule 17 CPC)

Jurisdictional & Appellate Practice Terms

Definition

The procedural mechanism allowing the court to permit either party to alter or amend their plaint or written statement at any stage of proceedings, provided the amendment is necessary to determine the real questions in controversy and does not alter the fundamental nature of the suit.

Example

A plaintiff in a recovery suit discovers during discovery that the defendant operates under an altered partnership name; the court allows an application under Order VI Rule 17 CPC to amend the defendant's description in the plaint.
