Amending the Decree (Section 152 CPC)

Jurisdictional & Appellate Practice Terms

Definition

The administrative-judicial power of a civil court to correct clerical, mathematical, or arithmetical mistakes in judgments, decrees, or orders arising from an accidental slip or omission, exercisable at any time suo motu or on application.

Example

A civil decree correctly details partition percentages but the typist accidentally writes ₹1,00,000 instead of ₹10,00,000 in the final recovery column; the court corrects the typo under Section 152 CPC without requiring a full appeal.
