Sufficient Cause

Jurisdictional & Appellate Practice Terms

Definition

A legitimate, real, and bona fide reason presented by a litigant to explain their inability to take a required legal step (such as appearing in court or filing an appeal) within the prescribed time, free from negligence or inaction.

Example

An advocate's flight was grounded due to a cyclone, preventing their appearance when a suit was called for hearing; this constitutes sufficient cause to set aside an ex-parte order under Order IX Rule 9 CPC.
