Condonation of Delay (Section 5 Limitation Act, 1963)

Jurisdictional & Appellate Practice Terms

Definition

The statutory power of an appellate or revisional court to admit an appeal or application filed after the expiration of the prescribed limitation period, if the appellant establishes "sufficient cause" for the delay.

Example

An appellant misses the 90-day deadline to file a Regular First Appeal by three weeks because they were in a medically certified coma following an accident; the High Court condones the delay under Section 5.
