Consent Decree

Jurisdictional & Appellate Practice Terms

Definition

A formal decree passed by a civil court recording a lawful, written compromise or settlement entered into voluntarily by the parties (under Order XXIII Rule 3 CPC), conclusively ending the litigation without a formal trial.

Example

In a partnership dispute, the partners file a signed settlement agreement apportioning company machinery and land; the court verifies their signatures and passes a consent decree in terms of the compromise.
