Non-Speaking Order

Jurisdictional & Appellate Practice Terms

Definition

An order that pronounces a conclusion, dismissal, or penalty without disclosing any underlying factual basis, rationale, evidence evaluation, or legal reasoning, rendering it vulnerable to being quashed in judicial review.

Example

A municipal commissioner cancels a commercial restaurant's health license by issuing a one-sentence notice stating "License canceled immediately." The High Court quashes the non-speaking order for violating natural justice.
