Speaking Order

Jurisdictional & Appellate Practice Terms

Definition

An order or judgment that contains clear, logical, and intelligible reasons for the conclusion reached, enabling the litigants and appellate courts to understand the judicial basis of the decision.

Example

An administrative tribunal dismisses a government employee’s suspension challenge with the single word "Rejected." The High Court sets aside the order, directing the tribunal to pass a reasoned, speaking order.
